Terms of Service

These Terms of Service ("Terms") govern your use of Issue Checker for Jira ("the App"), a Jira Cloud app distributed through the Atlassian Marketplace. By installing or using the App, you agree to these Terms.

1. Acceptance of terms

By installing, opening or using Issue Checker, you confirm that you have read, understood and agree to these Terms. If you do not agree, do not install or use the App.

If you use the App on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

2. Description of the App

Issue Checker reads the issues in one Jira project and lists what is wrong with their fields: fields nobody filled in, dates that contradict each other, dependencies that cannot work, and estimates that do not add up. It opens inside a project, as a gadget on a Jira dashboard, or as an app of its own from Jira's Apps menu. It provides:

• Thirty-four checks in five groups, and checks you write yourself as Jira filters
• A headline of how many issues need attention, and what is new or fixed since you last looked
• Dismissing and restoring findings
• Settings kept per person and per project

The App reads Jira only. It has no permission to change anything in Jira.

3. License and use

3.1 License grant

Subject to these Terms and payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the App with your Jira Cloud site.

3.2 Restrictions

You may not:

• Reverse engineer, decompile or disassemble the App
• Modify, adapt or create derivative works based on the App
• Sublicense, sell, resell or transfer the App to third parties
• Use the App for any unlawful purpose
• Attempt to get around license restrictions or access controls
• Use automated systems to abuse or overload the App

4. Distribution and the Atlassian platform

The App is distributed as an Atlassian Forge app. Your use may also be subject to:

• Atlassian Marketplace Terms of Use
• Atlassian Cloud Terms of Service

Where these Terms and Atlassian's terms conflict, Atlassian's terms prevail for your use of the Atlassian platform.

5. Fees and payment

The App's price is the one shown on its Atlassian Marketplace listing. You buy the App through the Atlassian Marketplace, and billing, billing cycles and refunds are governed by Atlassian's Marketplace policies.

If the price changes, the new price will be published on the Marketplace listing before it takes effect. You may keep using the App at the new price or uninstall it.

6. Data and privacy

Please read our Privacy Policy to see what the App reads, what it keeps and where.

You are responsible for making sure you have the permissions needed to install and use the App on your Jira site.

7. Intellectual property

Issue Checker, including its code, design and documentation, is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

You keep all rights to your Jira data. We claim no ownership of any data the App reads.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure or error-free
• Every problem in your issues will be found, or that every finding will be correct
• Any errors in the App will be corrected

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential or punitive damages
• Loss of profits, data, business or goodwill
• Any damages exceeding the fees paid for the App in the 12 months before the claim

This limitation applies whatever the theory of liability (contract, tort or otherwise), even if we have been told such damages are possible.

10. Indemnification

You agree to indemnify, defend and hold harmless the maker of Issue Checker from any claims, damages, losses or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Your breach of these Terms
• Your violation of any rights of a third party

11. Changes to the App

We may change or discontinue features with reasonable notice, update the App to improve how it works or its security, and change the price with notice on the Marketplace listing. We will make reasonable efforts to announce significant changes on the Marketplace listing or in the App.

12. Termination

12.1 By you

You may stop using the App at any time by uninstalling it from your Jira site.

12.2 By us

We may suspend or end your access if you breach these Terms or act in a way that harms the App or other users.

12.3 Effect of termination

When your use ends, your license ends with it. Uninstalling the App removes everything it kept in Atlassian Forge storage: settings, your own checks, dismissed findings and what the checks found last time. Your Jira data is not affected.

13. General provisions

13.1 Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13.2 Dispute resolution

Any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association.

13.3 Entire agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and the maker of Issue Checker about the App.

13.4 Severability

If any provision of these Terms is found unenforceable, the rest continue in effect.

13.5 No waiver

Not enforcing a right or provision of these Terms does not waive it.

14. Changes to these Terms

We may update these Terms from time to time. We will announce material changes on the Marketplace listing or in the App. Continued use of the App after a change means you accept the updated Terms.
